Form I-130 is the first step to facilitate the immigration of a family member to the United States and obtain a permanent residence card. Petition approval is based on proof of family relationship. Once approved, the family member can apply for the permanent resident card through adjustment of status or visa processing abroad. Some family members may have to wait for an available visa. If they are not eligible for adjustment of status or reside outside the United States, they can apply for a visa at a US embassy or consulate. It is crucial to correctly select the adjustment of status or visa processing option on the form. If you want to change this selection while the form is pending, you can contact the USCIS Contact Center to request the change. If you want to change your selection after form approval, you may need to file Form I-824, Request for Action on an Approved Application or Petition.
